HOW TO ENTER
a. These rules govern the 1010 WINS & Canon Maxify Printers Small Business Grant Challenge promotion (the “Promotion”), which is being conducted by 1010 WINS (“Sponsor”). The Promotion begins on October 30, 2017 and ends on December 6, 2017. Goodfriend Media, Inc. (“Administrator”) is administering the Promotion for Sponsor.
b. To enter the Promotion, entrant must visit http://1010WINS.com/Challenge (the “Website”) beginning on October 30, 2017 at 6:00:00am Eastern Time (“ET”) and ending on November 19, 2017 at 11:59:59pm ET (the “Entry Period”) and follow all links and instructions as set forth below:
i. Entrant must complete and submit the online entry form on the Website during the Entry Period and submit a video (the “Video”) of no longer than sixty seconds (:60) and/or a written statement of up to one thousand five hundred (1,500) characters (the “Essay”), each presenting their business or business idea, as well as how the $10,000.00 grant being awarded as part of the Grand Prize would help launch or grow their business. Video submissions must be in either .mov or .mpeg4 file format. Additionally, entrants must enter the business’ legal name and entrant’s first and last name, city, state, zip code, telephone number, date of birth and a valid email address in the online entry form. Entries may only be submitted by an owner or proprietor of the business. Online entrants are subject to all notices posted online. Only one (1) entry per person and per email address is permitted during the Entry Period. A business can be entered only once. Multiple participants are not permitted to share the same email address. Entries submitted may not be acknowledged or returned. Proof of submission of an entry shall not be deemed proof of receipt by the Administrator.
ii. Entrant must have the right to submit all content included in the Video and Essay (the “Content”), none of which may defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or proprietary rights including but not limited to copyrights or trademarks. The Content must be the original work of entrant, and any elements appearing in the Content, including, without limitation, photographs, comments, art, music or any other materials, must be entrant’s own original work, created by entrant, or be in the public domain. Further, by participating in the Promotion, entrant grants to Sponsor a perpetual, royalty-free license to use and publish the Video and Essay in connection with the Promotion and for marketing and promotional purposes in any media now existing or hereafter created without any notification, opportunity to review, right of approval or additional consideration whatsoever. Unless otherwise specified, any material, text or otherwise, included as part of the Content must be in the English language. No personal information, including, but not limited to, name, image or likeness of any person other than the entrant, or those from whom the entrant has obtained permission (or from their parents/guardians if individuals are minors), is to be included or referred to in the Content. As determined by Sponsor in its sole discretion, Content must not include, depict, reference or promote any indecent or inappropriate subjects or include obscenities, profanity, offensiveness, materially dangerous activities or violence, sexual explicitness, drug use, commercial products or services of third parties, material that is defamatory, disparaging, misrepresentative, discriminatory, false, misleading or otherwise unlawful or any material that infringes on another’s rights. Sponsor reserves the right to disqualify any entry that includes Content that it deems, in its sole discretion, to be indecent or inappropriate, unsuitable for public display, broadcast or posting on any Sponsor-administered website (i.e., entries must be radio clean), otherwise in violation of these guidelines or which communicates messages or images inconsistent with the positive images and/or goodwill with which Sponsor wishes to associate. Entries that do not comply with these guidelines may not be eligible. Any entry that includes an Essay that exceeds the character limit or Video that exceeds the time limit will not be eligible notwithstanding the submission being accepted. All entrants must agree to Sponsor’s online submission release in order to submit his or her Video and Essay.
c. There will be up to a total of ten (10) Qualifying Prize winning businesses and one (1) Grand Prize winning business selected in the Promotion.
a. The Promotion is open to all persons who are legal U.S. residents, thirteen (13) years of age or older, residing in New York, New Jersey or Connecticut as of October 29, 2017. An entrant’s small business must, as of October 29, 2017, also be headquartered or have a physical location within any of the aforesaid states and must be a privately owned and operated, for-profit, corporation, limited liability corporation, partnership, limited partnership or sole proprietorship with up to one hundred (100) employees. The Promotion is void where prohibited or restricted by law. Employees, officers, directors and agents of Sponsor, Canon U.S.A. Inc., Bridgehampton National Bank, Administrator and each of the foregoing’s affiliates (collectively, the “Promotion Entities”), the members of their immediate families (spouse, parents, siblings or children) and those living in the same household of each (whether related or not), are ineligible to enter or be an owner or proprietor of a winning business. This Promotion is subject to all applicable federal, state and local laws and regulations. By participating, entrant agrees to comply with these Official Rules and the decisions of Sponsor with respect to the Promotion, which are final and binding in all respects.
b. Each entrant who submitted a Qualifying Prize winning business may be required to present valid, government-issued, photo identification and to provide such entrant’s complete address, date of birth and phone number in order to claim the Qualifying Prize. Sponsor reserves the right to verify the identities and businesses of each winning business and the entrant who submitted it. Each such entrant will also be required to complete and return an affidavit of eligibility and liability and publicity release within three (3) business days of being contacted or the Qualifying Prize will be forfeited and the business will not be permitted to participate in the Event (as defined below).
c. Entrants are required to provide truthful information and Sponsor will reject and delete any entry that it discovers to be false or fraudulent. Sponsor will disqualify any entrant who does not meet the eligibility requirements and will also delete any entry as required by law.
a. Up to ten (10) Qualifying Prizes will be awarded in this Promotion. Sponsor reserves the right to award fewer Qualifying Prizes in the event that an insufficient number of entries are received. Each Qualifying Prize consists of one (1) Canon MAXIFY Printer and a $100.00 MasterCard Gift Card. Approximate Retail Value (“ARV”) of each Qualifying Prize is $225.00.
b. Up to one (1) Grand Prize will be awarded. The Grand Prize winning business will receive a grant in the amount of $10,000.00 in the form of a check issued in the name of the Grand Prize winning business and a $400.00 MasterCard Gift Card. ARV of the Grand Prize is $10,400.00. Total ARV of all prizes is $12,650.00.
c. A winner’s prize will not be awarded, processed or mailed until the winner has claimed the prize, presented all required documentation and signed all required releases and tax forms. The Grand Prize winner’s prize will be mailed to the Grand Prize winning business within ten (10) weeks of the winner being announced. Each winner will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of such winner’s prize. Each prize is awarded as is. The gift cards will be subject to the terms and conditions as set forth by the issuer of the gift card. Gift cards are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will gift cards be replaced if lost or stolen.
d. No more than the stated number of prizes specified in these Official Rules will be awarded. All prizes other than the Grand Prize Winner’s will be distributed at the Event. In the event that a prize is mailed or shipped to a winner, it will be with the prior written consent of the winner and winner assumes the risk of its loss. The Promotion Entities are not responsible for the safe arrival of any prize.
e. Prizes are not transferable, and no substitution, assignment or cash equivalent of any prize is permitted, except by Sponsor (solely at its discretion), which reserves the right to substitute a prize or prize portion with another prize or prize portion of greater or equal value. The prizes are expressly limited to the items listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Promotion Entities are not responsible for a winner’s limitations that prevent acceptance or use of such winner’s prize. Entrants acknowledge that the Promotion Entities have not made, and are not in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties, expressed or implied, whether by contract or law, concerning any prize, including, without limitation, implied warranties of quality, merchantability, mechanical condition or fitness for a particular purpose. Other restrictions may apply.
WINNER SELECTION AND NOTIFICATION
a. Up to ten (10) Qualifying Prize winning businesses will be selected as follows:
i. Eligible Videos and Essays submitted will be posted on the Website during the Entry Period for review by members of the public who will be able to vote for the business they believe should win the Grand Prize. Voting will commence on the Website at 12:01am ET on November 20, 2017 and end at 11:59:59pm ET on November 26, 2017 (the “Voting Period”). Voting is open to legal residents of the United States, thirteen (13) years of age or older, who register on the Website during the Entry Period or the Voting Period. A person may only vote once and only one vote per email address is allowed during the Voting Period. The up to fifty (50) eligible businesses that receive the most votes during the Voting Period will then be submitted to a panel of judges selected by the Sponsor in its sole discretion. On or about November 27, 2017, the judges will select up to ten (10) Qualifying Prize winning businesses from among the up to fifty (50) submitted businesses. The judges will base their selection on the originality, persuasiveness and creativity of the Essays and Videos and the worthiness of the use to be made of the $10,000.00 grant.
ii. Sponsor will contact the entrants who submitted the potential Qualifying Prize winning businesses by telephone and/or email no later than November 30, 2017. If an entrant who submitted a potential Qualifying Prize winning business cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability and publicity release within three (3) business days of being contacted or if a prize or prize notification is returned as undeliverable, the potential Qualifying Prize winning business forfeits the Qualifying Prize and the right to participate in the Event and Sponsor may select another winner from among the other top fifty (50) vote receiving businesses using the criteria set forth above.
b. Up to one (1) Grand Prize winning business will be selected from the up to ten (10) Qualifying Prize winning businesses as follows:
i. The entrant who submitted a Qualifying Prize winning business (the “Representative”) must attend the 1010 WINS & Canon Maxify Printers Small Business Grant Challenge Event (the “Event”) to be held on December 6, 2017 from 2:00pm ET - 6:30pm ET at the CBS Radio Adorama Live Performance Space located at 345 Hudson Street, 10th Floor, New York, NY 10014 in order to claim the Qualifying Prize and be eligible to win the Grand Prize. In the event the Representative of a potential Qualifying Prize winning business does not agree to attend the Event, the Sponsor reserves the right to select an alternate Qualifying Prize winning business using the judging criteria above.
ii. Each Representative must check in with Sponsor’s staff at the Event by 3:30pm ET in order to receive the Qualifying Prize and to be eligible to win the Grand Prize. Starting at approximately 5:30pm ET, each Representative will have an opportunity to step on stage and give a ninety second (:90) “elevator pitch” followed by approximately three and one half (3½) minutes of questioning from a judging panel made up of three (3) judges designated by Sponsor (the “Judging Panel”). The Event, including each Representative’s participation in the Event, may be streamed live on the Website, Facebook Live and/or other media.
iii. After a Representative has given his/her pitch and answered the Judging Panel’s questions, one (1) Grand Prize winning business will be selected from among the Qualifying Prize winners. The determination will be based 25% on voting by the studio audience and online voters and 75% by the Judging Panel which shall base its decision on the originality, persuasiveness and creativity of the pitches, responses to questions and the worthiness of the use to be made of the $10,000.00 grant. Voting by the studio audience and members of the public who are not in attendance at the Event will be through the Website, commencing when the pitches begin and continuing until the Judging Panel conclude their deliberations. Voters must be legal United States residents, thirteen (13) years of age or older who have previously registered to vote during the Voting Period or who subsequently register in order to vote for the Grand Prize winner. Only one vote per person and only one vote per email address is allowed during this voting period. The potential Grand Prize winning business will be announced at the conclusion of the Event.
a. Payments of all federal, state and local taxes are solely the responsibility of the businesses that win the prizes. The winning businesses may be required to complete and submit an IRS Form W-9 with the business’ full Federal Tax Identification Number or the equivalent for receipt of any prize valued at $600.00 or more or for any prizes awarded by Sponsor in a calendar year with an aggregate value of $600.00 or more. Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize. Such winnings of $600.00 or more will be reported to the IRS.
b. Participation in the Promotion and/or acceptance of a prize constitutes the entrant’s and the winning business’ permission for Sponsor or its designees to interview the winners, to photograph, film and record each entrant, and to use in commerce and in any media, now or hereafter known, throughout the world, in perpetuity, such entrant’s and business’ name, prize won, hometown (city and state), biographic information, likeness, photograph, voice, audio or video recording and/or any statements made by him/her regarding the entrant’s business, Sponsor, the other Promotion Entities and the Promotion for purposes of trade, publicity or promotion without notice or additional compensation, notification or permission, in perpetuity, except where prohibited by law. Each entrant who submitted a winning business agrees to sign a publicity release confirming such consent prior to acceptance of a prize, except where prohibited by law.
c. Participation in the Promotion and/or acceptance of a prize constitutes entrant’s and the entrant’s business’ agreement to release, discharge and hold harmless the Promotion Entities and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns (collectively, the “Released Parties”) from and against any and all claims or liability arising directly or indirectly from any prizes awarded and participation in the Promotion, including, but not limited to, personal injury, death or damage to or loss of property, which may occur in connection with, preparation for, travel to, or participation in the Promotion, or delivery, possession, acceptance and/or use or misuse of any prize or participation in any Promotion-related activity, including, but not limited to, any claims based on publicity rights, defamation, invasion of privacy and merchandise delivery.
d. If for any reason this Promotion cannot be executed as planned, including but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Released Parties that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to cancel, terminate, suspend and/or modify the Promotion. If the Promotion is terminated before the original end date, Sponsor reserves the right, in its sole discretion to, to modify the procedure for selecting winners, unless the nature of the event giving rise to such termination renders it impossible to select winners. Sponsor also reserves the right to disqualify any entrant’s business if Sponsor in good faith believes that (i) there have been irregularities in the voting for such entrant’s business; or (ii) the entrant or someone acting on the entrant’s behalf have engaged in activities intended to undermine the integrity of the voting process.
e. The Released Parties are not responsible for (i) typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of prizes; (ii) incorrect or inaccurate entry information, human error, failure or omission; (iii) unauthorized human intervention; (iv) lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late entries; (v) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties, telephone service outages, delays, busy signals, poor signals or signal interference, accidental disconnection or equipment malfunctions or any other technological problems or failures of any kind; or (vi) any cancellations, delays, diversions, substitutions or omissions whatsoever by any transportation providers or any other persons or entities providing any services to winners (and guests, if applicable) including any results thereof such as changes in services or location necessitated by same. Further, the Released Parties are not responsible if any part of a prize cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism or other factors beyond the Released Parties’ control.
f. Any attempt by any entrant or voter to obtain more than the stated number of entries or votes by using multiple/different email addresses, identities, registrations and logins or any other methods may void that entrant's entries or voter’s votes and that entrant and entrant’s business may be disqualified. The use of any device to automate entry or voting is prohibited. Any use of robotic, repetitive, automatic, programmed or similar entry or voting methods or agents (including, but not limited to, promotion entry services or proxies) will void all entries or votes by that entrant or voter at Sponsor's discretion. Administrator’s computer system is the official time keeping device for this Promotion. In the event of a dispute, online entries will be deemed to have been submitted by the Authorized Account Holder. The "Authorized Account Holder" is the natural person who (i) is assigned to an email address by an internet access provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address or (ii) is assigned to the text or mobile telephone number by a telecommunications provider, or other organization that is responsible for assigning such numbers. Sponsor, in its sole discretion, reserves the right to disqualify any person who it believes is tampering with the entry process or the operation of the Promotion. Failure to comply with the rules of the Promotion may result in an entrant’s disqualification and/or forfeiture of any prize or prizes. If Sponsor makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, Sponsor may disqualify that entrant from entering and/or winning this and any or all future Sponsor-administered Promotions and seek damages to the fullest extent permitted by law.
g. Sponsor reserves the right to make changes to the rules of the Promotion, including, without limitation, the substitution of prizes of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Promotion Entities, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, Sponsor reserves the right, but not the obligation, to cancel, terminate, suspend or modify the Promotion and shall not be required to award substitute prizes.
h. Except where prohibited, by entering the Promotion, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in New York, NY; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall such costs include attorneys' fees; (3) no punitive, incidental, special, consequential or other damages, including, without limitation, lost profits may be awarded (collectively, "Special Damages"); and (4) entrant hereby waives all rights to claim Special Damages and all rights to have any damages awarded multiplied or increased. New York law governs the interpretation and construction of these Official Rules and all aspects related thereto.
i. By entering the Promotion, entrant understands that entrant’s email address will be used by Sponsor for promotional follow up emails. Canon and/or Station and its promotional partners’ news and information will be directed to all individuals participating in the voting and those participating in any viral social media related to the Promotion.
j. For a copy of these Official Rules, send a self-addressed stamped envelope for receipt by November 30, 2017 to “Canon Grant Challenge – Official Rules,” Attn: Promotions, WINS(AM), 345 Hudson Street, 10th Floor, New York, NY 10014. For the names of the prize winners, send a self-addressed stamped envelope for receipt by March 1, 2018 to the above address marked “Canon Grant Challenge – Winner List.” The Official Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of Sponsor and may be posted online on the Website.
